DAJ- Firearms and Dangerous Weapons

Purpose

To clarify who may lawfully possess a firearm or dangerous weapon on district property.

Definitions

Dangerous Weapons: an item that in the manner of its use or intended use is capable of causing death or serious bodily injury as determined by the following factors:

  • The character of the item, instrument, or thing
  • The character of the wound produced, if any
  • The manner in which it is exhibited or used;

Firearm: a device from which is expelled a projectile by action of an explosive.

On or about school premises: in or on the grounds of any district school or district property.

Policy

No person shall possess a dangerous weapon that in the manner of its use or intended use is capable of causing death or serious bodily injury or a firearm on or about school premises except:

  • Persons exempt from weapons laws by state statute (law enforcement officers and others)
  • Persons authorized to possess a concealed firearm by statute (concealed weapons permit holders)
  • Persons whose possession has been previously approved by the responsible school administrator or where the person responsible for the possession or use of the weapon is in possession or control of the weapon and it is present or to be used in connection with a lawful activity, approved by the building administrator

Possession of a dangerous weapon on or about school premises is a class B misdemeanor and a violation of the district Safe Schools Policy.

Possession of a firearm on or about school premises is a class A misdemeanor and a violation of the district Safe School Policy.

  • Possession of a dangerous weapon or firearm on or about school premises is permissible if the possession is on the person's real property or in a vehicle lawfully under the person's control, other than a vehicle owned by the district or used for the transport of students.

A person under the age of 21 with a permit of any kind to carry a concealed firearm may not carry a concealed firearm on or about school premises.

Violation of this policy is violation of the law.
